1. Scope and Services
The Alteran Group (“we,” “us,” “our,” or “Company”) provides custom web design, development, hosting, and maintenance services exclusively for small-to-medium for-hire trucking carriers and owner-operators (“Client,” “you,” “your”). Services are offered in three tiers:

2. Payment Terms
- Build Price (One-Time, Paid Upfront): Full payment of the build price is due immediately upon purchase. Payment is non-refundable due to the short turnaround window and immediate allocation of development resources.
- Monthly Hosting & Maintenance Fee: Recurring monthly fees are due on the same day each month (the “Service Anniversary Date”). Payment is required in advance for continued service.
- Accepted Payment Methods: We accept credit cards, ACH transfers, and invoice-based payment. All payments must clear before service begins.
3. Non-Refundable Build Services
The build price is fully non-refundable. This applies because:
- We begin work immediately upon payment, deploying paid labor hours and resources to your project.
- All deliverables are custom fitted to your business information and cannot be re-sold or repurposed.
- Refunds are not available even if you cancel after work has begun.
4. Revision Policy
Your build package includes 2 (two) rounds of client-requested revisions at no additional charge. Additional revisions are billed at $75/hour.
- What Counts as a Revision: Changes to copy, design, layout, colors, or functionality requested by you.
- Company-Caused Corrections: If an error is determined to be caused by The Alteran Group (e.g., incorrect data entry, broken functionality we introduced, missed deliverable), we will correct it at no charge, regardless of revision count.
- Revision Requests: Submit revision requests in writing to your project contact within 7 days of delivery. Requests submitted after this window will be treated as new projects or ongoing maintenance.
5. Intellectual Property Ownership
- You Own: Your finished website, domain name, website content (copy, photos, information), and data collected through your site.
- We Own: Our underlying code, design templates, systems, client portal software, and proprietary development processes. These remain our exclusive property and are reused across clients.
- License Grant: For the duration of your service, you have a non-exclusive, non-transferable license to use our code and design templates solely for your website. This license terminates if you cancel the service.
6. Hosting and Domain Management
- Hosting Provided: We provide reliable web hosting as part of your build package and ongoing monthly service. Hosting is included in your monthly fee and is not available separately.
- Domain Registration: We register your custom domain and manage it on your behalf. You own the domain name; we manage DNS, renewals, and technical configuration. Domain renewal costs (typically $20–40/year) are included in your monthly fee.
- Uptime: We provide hosting on a best-effort basis. We do not guarantee specific uptime percentages (SLA). We maintain standard security, backups, and monitoring.
7. Monthly Hosting and Maintenance
Your monthly fee covers:
- Web hosting and server maintenance
- Domain name registration and renewal
- Email account setup and maintenance (if included in your tier)
- Security patches and software updates
- Backup management
- Standard support (24–48 hour response time)
8. Payment Failure and Account Suspension
- Grace Period: If your monthly payment is not received by the due date, you have a 10-day grace period to remit payment without penalty.
- Collection Notice: If payment is not received within 10 days of the due date, we will send a formal collection notice with a 14-day payment deadline.
- Account Suspension: If payment is not received within 14 days of the collection notice, your site will be taken offline. Email services will continue to function.
- Reinstatement: Your site can be restored immediately upon payment of all outstanding amounts.
- Permanent Cancellation: If an account remains unpaid for 3 (three) consecutive months, the account will be permanently cancelled. After permanent cancellation, we have no obligation to restore data or service.
9. Account Cancellation
- How to Cancel: You may cancel your account at any time by providing written notice (email is acceptable). Your account will be cancelled at the end of your current billing month.
- Final Payment: You remain responsible for all monthly fees through the end of your billing period, even if you cancel mid-month.
- Data Delivery: Upon cancellation, we will provide you with a complete copy of your website, content files, and data within 10 business days. This is the sole remedy for cancellation and is not a refund of fees.
- Site Availability After Cancellation: Once your account is cancelled, your website will no longer be hosted on our servers. You will need to secure alternate hosting to maintain your online presence.
10. Warranties and Disclaimers
The Alteran Group makes the following limited warranties:
- We will deliver the website according to the specifications in your Tier-Specific SOW within the stated timeline.
- We will maintain reasonable security practices to protect your data. However, no system is 100% secure, and we do not warrant against hacking, data loss, or third-party attacks.
EXCEPT AS EXPRESSLY STATED ABOVE, THE ALTERAN GROUP MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Your website is provided “as-is.” We do not warrant that your site will generate leads, increase sales, or achieve any particular business outcome.
11. Limitation of Liability
To the fullest extent permitted by law:
- The Alteran Group is not liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of revenue, lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.
- Our total liability under these Terms, regardless of the cause, will not exceed the total amount you paid to us in the 12 months immediately preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless The Alteran Group, its owners, employees, and agents from any claims, damages, costs, or expenses (including attorney fees) arising from your use of the website, your violation of these Terms, your content, or your business operations.
13. Data Privacy and Security
- Customer Data: You own all the data you provide to us (business information, photos, content). We will not share, sell, or use this data except to deliver your website and services.
- Lead Data: If your website collects leads (e.g. quote requests, driver applications), you own that lead data. We will deliver it to you via email or form notification as it arrives.
- Security: We implement standard security measures (SSL encryption, firewalls, regular backups). You are responsible for strong passwords and protecting your admin credentials.
- Confidentiality: We will not disclose your customer data, business information, or leads to third parties without your written consent, except as required by law.
14. Dispute Resolution
- Good Faith Negotiation: Before pursuing formal legal action, both parties agree to attempt resolution through good-faith communication for a period of 14 days.
- Jurisdiction: These Terms are governed by the laws of Virginia, without regard to its conflict of laws principles.
- Venue: Both parties consent to the exclusive jurisdiction of the state and federal courts located in Fairfax County, Virginia for resolution of any disputes.
15. Changes to Terms
We may update these Terms at any time. Changes are effective 30 days after we notify you (via email or website notice). Your continued use of your website constitutes acceptance of the updated Terms. For material changes that negatively affect your rights, we will provide 60 days' notice.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be removed, and the remaining provisions will remain in full force and effect.
17. Entire Agreement
These Master Terms of Service, together with the Tier-Specific Statement of Work applicable to your purchase, constitute the entire agreement between you and The Alteran Group regarding the services provided. Any prior negotiations, representations, or agreements not expressly included here are void.
